The General Counsel & Corporate Affairs Committee Meeting held its third meeting on Wednesday, 12th February 2020 at Pernod Ricard’s office in Gurugram.

The General Counsel & Corporate Affairs Committee Meeting held its third meeting on Wednesday, 12th February 2020 at Pernod Ricard’s office in Gurugram.

Mr. Rajiv Chauhan, Chairman of IFCCI General Counsels and Corporate Affairs Heads Committee and General Counsel at Pernod Ricard initiated the discussion and highlighted the roadmap for the next 3 months:

Two key points have been identified as action points and broad agenda for this committee over the next few months

1.    The committee will prepare a representation to push for the enforcement of an anti-corruption bill/law similar to Sapin II, FCBA which would be instrumental for providing a level playing field to multinational companies operating in India. If India wishes to achieve its target of becoming a $5 trillion economy in the next five years and if it wants to attract more foreign companies to invest in India, a robust compliance system is necessary. 

The steps entail the following:
-    IFCCI will identify a knowledge partner to assist in conducting a survey among companies, collating information and drafting a white paper.
-    IFCCI will seek a meeting with officials from NITI Aayog or Ministry of Corporate Affairs to seek inputs.
-    White paper to be finalized by beginning to mid April 2020
-    This will be a joint effort between the committee members, IFCCI and the Embassy of France in India

2.    Tax Issues and Litigation – Alternate dispute resolution mechanisms (Mediation between French companies, CAG and others). This will focus mainly on indirect taxes. Rajiv will prepare a small presentation to be shared with the core committee. It was agreed to bring out the issues of Awareness, Compliance Rating, Redressal Tax Issues and Litigation to the larger group of General Counsels and Corporate Affairs and organize inter sector committee meetings with CFO.
