The Indo French Chamber of Commerce & Industry (IFCCI) organised a PAN-India webinar on Analysis of Draft Defence Procurement 2020 & Impact of COVID-19 on the Defence Industry on Thursday, the 30th April 2020.
The discussion began with a welcome note by Mr. Priyank Prakash, Manager – Events & Membership, IFCCI, followed by Mr. Emmanuel de Roquefeuil, VP & Country Director, Thales India, and Chairman of the IFCCI Defence & Aerospace Committee inaugurating the session.
Mr. Yogesh Singh, Partner, and his colleague Ms. Nitika Chhabra, Counsel from Trilegal, shared their expertise on:
(i) Draft DPP
- Key Changes proposed in the draft DPP (short introduction)
- Overview of the offset guidelines; Impact of the changes in the offset guidelines; Suggestions and thoughts on the offset policy
- New change in the definition of Indian Vendor – requirement for it to be owned and controlled by Indian citizens.
- Standard Form Contract – Some inclusions have been made, but what are the key principles/clauses that it is still missing on
(ii) Impact of COVID on the defence sector
- Impact of current lock-down on obligations under defence contracts – particular focus on obligations under contracts with international parties, which may not be under lock-down and are can continue to perform their part of the contract.
- Can Indian contracting parties claim force majeure/frustration in view of the current pandemic?
The webinar ended with an interactive Q&A session and saw an active participation of 100+ business heads from the Indo-French Business Community.
