The Indo-French Chamber of Commerce & Industry (IFCCI), under its Industries Committee, organized a Webinar on Fundamentals of Construction Disputes on 9th August 2023. The session covered the basics and the need for contract management, common issues that lead to a dispute and the best approach towards mitigating disputes for the various industries.

Ms. Aarushi Gautam, Manager - Committees & Events (North), IFCCI, while welcoming the participants and speakers, Mr. Ishan Khanna, Partner, Legacy Law Offices LLP, Mr. A. Shankar, India Head - Government Advisory & Solutions, JLL India and Ms. Sadiqua Fatma, Senior Partner, Legacy Law Offices LLP for the session, introduced IFCCI Committees and the objective of organizing such knowledge-sharing sessions that add value for our members.

Mr. Ishan Khanna, Partner, Legacy Law Offices LLP set the context for the discussion by highlighting the major forms of construction contracts prevailing in India and the clauses around it. Mr. A. Shankar, India Head - Government Advisory & Solutions, JLL India, in his remarks, shared an industry perspective and a general outlook of the construction industry. He touched upon the current scenario, challenges faced, and innovations made in the PPP model for government infrastructure projects. Ms. Sadiqua Fatma, Senior Partner, Legacy Law Offices LLP, talked about the issues which lead to construction disputes and gave a brief into the claim preparation, litigation, arbitration, and analysis methodology.

This was followed by a conversation between MS. Sadiqua Fatma, Mr. A. Shankar, and Mr. Ishan Khanna. They shared their experiences of dealing with construction related contracts in India and other neighboring countries, management contracts, amicable resolution of disputes by the government, cost-effective solutions, and fair compensation.

Overall, the discussion had a comprehensive exploration of the intricacies involved in construction contracts in India and its neighboring countries, aiming to ensure efficiency, fairness, and the smooth progression of projects.

This was followed by an interactive session with participants wherein speakers addressed several queries pertaining to the subject.

Ms. Tracy Fernandes, Senior Manager - Events and Membership (Western Region) and SPOC, Industries Committee, concluded the Session by thanking the participants and experts for an insightful session.
