IFCCI, in association with BMC Advisors, Advocates, organized a Webinar on Impact of Covid-19 on FDI and Contractual Obligations on Wednesday, 6th May 2020.
Ms. Rishika Roy, Head Committees & Events, IFCCI opened the Session and welcomed the Speakers and Participants.
Interesting observations were shared by Ms. Sushma Mathur, Partner, BMC Advisors, Advocates on the existing FDI & FPI rules and the recent changes made in the wake of the Coronavirus pandemic. Implications of recent foreign investments by our neighbouring countries were also discussed.
Ms Shagun Bhargava, Advocate, discussed the legal aspects of performance of contracts during such testing times. The legal tools of Force Majeure and the Doctrine of Frustration were also discussed. Moving forward aneed of proper documentation to avoid disputes was emphasised. Various Supreme Court judgements were also elaborated to convey a realistic picture to the participants. Both the speakers agreed that honouring financial commitments is the biggest issue at these times and this necessitates reworking of contracts.
The informative session was followed by an interactive Q&A round. The webinar was attended by over 50 participants.
