The Indo-French Chamber of Commerce & Industry (IFCCI), in partnership with Dua Associates, successfully organized a virtual session on 'Decoding the Law on POSH' on Friday, 29th August 2025.

The session opened with welcome remarks by Ms. Aarushi Gautam, Senior Manager – Committees & Events (North), who emphasized the importance of the new reporting obligations introduced under the Companies (Accounts) Amendment Rules 2025. She noted that these developments place increased accountability on organizations to ensure compliance and to navigate complex areas of interpretation under the POSH Act.

Our expert speakers, Ms. Janini Somiah, Partner, and Ms. Anvita Harish, Associate, from Dua Associates, delivered in-depth perspectives on the practical and legal dimensions of the subject.

Session's Key Insights Included:

  • Challenges around Internal Committees' constitution and functioning, along with solutions for ensuring compliance and effectiveness

  • Step-by-step handling once a complaint is filed, including jurisdictional issues and case-specific scenarios (e.g., when the respondent is a woman too)

  • When and how a case may be pursued, along with best practices to ensure fairness and sensitivity

  • Managing hurdles such as respondent's behavior or balancing factors such as intent vs perception when determining outcomes to provide the final conclusion 

  • Addressing misuse of the Act in the backdrop of false or malicious complaints while safeguarding genuine grievances

  • Recommended good practices for smooth functioning of Internal Committees and case management

  • Adapting to new mandates, case law, and the changing regulatory landscape

The session attracted over 90 participants from across the Indo-French business community and concluded with an interactive Q&A session, fostering dialogue and clarifying critical concerns.
